PUBLICATION. BOOK

Small Claims: The Case For Consumer Courts in Nigeria.

The laws for consumer protection in Nigeria beginning with the apex law FC CPA 2018 and other sector specific laws make provisions for the protection and enforcement of consumer rights when they are breached. However the level of enforcement of the rights of the cobsumer to an effective redress through litigation in the courts is called into question as a result of road blocks placed in the way of the vulnerable and poor consumer in a long, protracted and costly litigation in Nigeria.

This book advocates for the Nationwide institutionalization and strengthening of Small Claims Courts as a transformative solution to the systematic delays that disproportionately affect everyday citizens and the vulnerable consumer.

What is ICRP and what does it do?

Institute for Consumer Rights and Product Liability Protection Ltd/Gte (ICRP) is a private, independent, non-profit organisation dedicated to protecting Nigerian consumers. We advocate for consumer rights, resolve complaints, educate the public, engage policymakers, publish research, and take legal action, including litigation against companies/organisations and individuals who violate consumer rights. We serve all Nigerians across all 36 states and the FCT.

Is ICRP a government agency?

No. ICRP is a fully private, independent, non-profit organisation and not a government agency. We are registered in Nigeria as a company limited by Guarantee (Ltd/Gte). Our independence means that we are free from political, corporate, or governmental influences, and our only obligation is to the Nigerian consumer. We promote and support Government policies and programmes that promote consumer rights, well-being, safe products and services in Nigeria.

Who can file a complaint with ICRP?

Any Nigerian consumer who has been treated unfairly in a commercial transaction can file a complaint with us. This includes people who have purchased defective products, received substandard services, been misled by false advertisement, overcharged, had a contract breached, or suffered a health or safety risk from a product or service. You do not need to hire a lawyer to file a complaint with us. Our complaint process is accessible and confidential.

How does the complaint process work?

The process is straightforward. Step 1: Walk into any of our offices or submit your complaint online using our Consumer Complaint Form – provide your personal details, the company/organisation or individual involved, and a description of what happened.
